KALEIDA HEALTH POSTS LABOR BOARD NOTICE AFTER CHARGES FOR THE BGH RNs

On December 27, 2021 CWA 1168 filed a labor board charge against Kaleida Health for their refusal to provide information vital to enforce the contract and protect union members’ rights.
The information that was requested was to protect the bargaining unit work of the BGH RNs, but more specifically in this case for the OR nurses and RNFA’s at Buffalo General.
When the information was requested, HR and Kaleida’s legal department refused to provide the information stating that it was not relevant or pertinent to the grievance and that we were not entitled to the information because we were asking for the qualifications and certification of a manager as well as their approved PTO.
These pieces of information were important as they would:
  1. Reinforce our case that the manager was performing our bargaining unit work without being qualified to do so; and
  2. Prove that the manager performing our bargaining unit work was on the clock as a manager, not on their clinical time or approved PTO hours.
Region 3 of the National Labor Relations Board found merit in the charge CWA 1168 filed against Kaleida Health, and the case was set to be heard by a judge.
In the time leading up to the hearing, CWA 1168 and Kaleida Health reached a settlement on the matter to post a “Notice To Employees”. This posting is pursuant to a settlement agreement approved by a regional director of the National Labor Relations Board.
This posting was physically posted at Buffalo General Hospital and sent out to all BGH RNs via their Kaleida Health email address. The posting, in short, states:
CWA 1168 has received the information, though delayed, and upon initial review, we feel that the information supports the union contention alleged in the grievance. We will be moving this grievance forward through the grievance procedure outlined in the collective bargaining agreement.
